Either Samsung has fixed the problem or people are getting cases of varying quality or it's user error. Another user noted this: "You have to make sure you place the pen in with the flat side facing up as designed because it's narrower when turned sideways." This user may have hit on why there are so many reviews on this site and others about why the pen falls out. My case was perfect. The pen fits in there tight; no ability to move it around. You have to click the button firmly before it releases the pen. I love the colors of the yellow pen against the blue case. The colors pop with this combination.
